Clients' company information will be treated with the utmost confidentiality and security within our organization.

• Project payments must adhere to the terms outlined in the payment section, and no deviations from these terms will be accepted.

• Any changes in project functionality requested during development, beyond the defined scope, will be considered new requirements and quoted with associated costs. Change Requests (CRs) will be addressed only after payment.

• Project timelines may be subject to extension based on changes in requirements.

• The provided quote is applicable solely to the specified requirements mentioned above.

• MDQuality Apps Solutions bears no responsibility for any losses or copyright issues related to app photos, videos, or content at any point in time, as the client retains sole ownership of the provided/collected content.

• No AMC added in the project cost, any changes, update or maintenance after final delivery we are not in a position to accommodate it for free of cost.

• The client grants MDQuality Apps Solutions permission to reference their website and contact details as a client on the MDQuality Apps Solutions website.

• Third-party services: Costs for third-party plugins, hosting, domain registration, or special software not included in the initial scope.
• Extended support: Ongoing maintenance or support beyond the initial post-launch period.

Q3: What payment methods do you accept?
A: We accept payments via bank transfer, credit card, or other agreed-upon methods. Details will be provided in the invoice.

1.2 Changes and Modifications
Q1: What if we need to make changes after the project has started?
A: We understand that requirements can evolve. We offer a structured change request process:
• Change Request Form: Submit a request detailing the desired changes.
• Assessment: We'll assess the impact on the timeline and cost.
• Approval: Changes will be implemented upon approval and agreement on the revised scope and cost.

Q2: Can we add new features during development?
A: Yes, new features can be added, but they may require adjustments to the timeline and cost. We'll provide an estimate for the additional work before proceeding.
Q3: What if the Website and/or Mobile needs updates after launch?

Q2: How do you handle project delays?
A: We strive to adhere to the agreed timeline. However, delays may occur due to unforeseen circumstances or additional client requests. We will communicate promptly about any delays and work to minimize their impact.

1.1.2 Post-Launch Support and Training
Q1: What support do you provide after the website is launched?
A: We offer free post-launch support for 2 months for bug fixes, minor adjustments, and security updates. Additional support can be arranged based on your needs but it is chargeable.
Q2: Will we receive training on how to manage the website?
A: Yes, we provide training sessions to help you and your team understand how to use the content management system (CMS) and manage the website in one planned meeting if you request for the training. Q3: Do we will get free maintenance or bug fixes support after final delivery or project handover.?
A: No, we don’t provide any bug fixes or maintenance support without an AMC signed.

1.1.3 Confidentiality and Intellectual Property
Q1: Who owns the website and its content after completion?
A: Upon full payment, ownership of the website, mobile app and its content transfers to you. This includes all design elements, code, and content created for the project.
Q2: How do you ensure the confidentiality of our information? A: We have a strict confidentiality policy to protect your sensitive information. A non-disclosure agreement (NDA) can be signed if required.

Q1: How will we communicate during the project?
A: We use a combination of email, phone calls, and video conferencing for communication. Q2: Do you provide hosting services?
A: While we primarily focus on website development, we can recommend reliable hosting providers or arrange hosting services on your behalf. The cost of hosting is typically not included in the proposal.
Q3: What about backups and data security?
A: We implement regular backups and follow best practices for data security. If required, we can set up automatic backups and provide additional security measures like SSL certificates, firewalls, and regular security audits. But this is chargeable and comes with AMC cost. You have to ask for AMC (Annual Maintenance Cost) to handle your application post final delivery.

Q1: Will the website be SEO-friendly?
A: Yes, we implement SEO best practices during the development phase, including optimizing site structure, meta tags, keywords, and performance. For ongoing SEO strategies and digital marketing, we offer separate services or can recommend trusted partners.
Q2: Can you help with content creation?
A: We can assist with content creation, including copywriting, graphic design, and multimedia production. This service may or may not be included in the proposal or provided as an additional service upon your request.
Q3: Do you offer social media integration and marketing services?
A: Yes, we can integrate social media platforms and provide tools for social media sharing. We also offer social media marketing services, which include strategy development, content creation, and management.

Q1: Can the website or mobile app be customized after launch?
A: Absolutely. The website will be built with scalability in mind, allowing for future updates and feature additions. We can provide ongoing support for any customizations you may need but it is chargeable.
Q2: What level of customization is possible?
A: The level of customization is determined by your requirements and budget. We can create custom functionalities, design elements, and integrations to meet specific needs.

Q1: Will the website or mobile comply with legal requirements?
A: We ensure the website complies with general legal standards, including GDPR (for EU clients), accessibility standards (e.g., WCAG), and other relevant regulations. However, we recommend consulting with a legal expert for specific compliance needs and this activity is not covered in the proposal budget.

Q2: Who is responsible for the content posted on the website?
A: You, the client, are responsible for the content posted on the website, including ensuring it does not infringe on copyrights or other intellectual property rights. We can assist in reviewing content but the final responsibility lies with you.

MDQ does not endorse, sanction or verify the accuracy or ownership of the information contained in/on any Third Party Site or any products or services advertised on Third Party Sites. If you decide to leave the Site and navigate to Third Party Sites, or install any software or download content from any such Third Party Sites, you do so at your own risk. Once you access a Third Party Site through a link on our Site, you may be subject to the terms and conditions of such Third Party Site. You should review the applicable policies, including privacy and data gathering practices, of any Third Party Site to which you navigate from the Site, or relating to any software you use or install from a Third Party Site, including any applicable license agreement. Concerns regarding a Third Party Site should be directed to the Third Party Site itself. MDQ bears no responsibility for any action associated with any Third Party Site.

3. Open Source Software

Open source software licenses for components of MDQuality Apps Solutions LLP released under an open source license constitute separate written agreements. To the limited extent that the open source software licenses expressly supersede these Terms, the open source licenses govern your agreement with MDQ only for the use of the components of Project Hub released under an open source license.

4. Monitoring of Content

You understand that our company may access and disclose Customer Data or otherwise provide third parties access to it for the following reasons:

  • to send an email message to you upon your request;
  • to maintain the Site and to develop new and useful features and services;
  • to follow a court order, subpoena, complaint or a lawful request from governmental authorities;
  • to enforce these Terms;
  • to respond to claims that any Customer Data or Content violates third party rights;
  • to respond to your requests for customer service; and
  • to protect the rights, property, or personal safety of MDQ, users of MDQ’s offerings, including without limitation, and the public.

5. Our Copyright Dispute Policy

MDQuality Apps Solutions LLP respects the intellectual property of others and requires that our users do the same. If you believe that material or content residing on or accessible through MDQ infringes a copyright, please send a notice of copyright infringement containing the following information to the Designated Copyright Agent listed below:

  • identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
  • identification of the claimed infringing material and information reasonably sufficient to permit us to locate the material on MDQ (providing the URL(s) of the claimed infringing material satisfies this requirement);
  • information reasonably sufficient to permit us to contact you, such as an address, telephone number, and an email address;
  • a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  • a statement by you, made under penalty of perjury, that the above information in your notification is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf; and

We do not offer any support, maintenance, or assistance for this application unless a separate Annual Maintenance Contract (AMC) is signed. In the absence of an AMC, users are solely responsible for any issues, malfunctions, or damages arising from the use of this application. Use of the application built by is entirely at your own risk.

WE DO NOT GUARANTEE THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF PROJECT/APPLICATION WILL BE EFFECTIVE, RELIABLE OR ACCURATE OR WILL MEET YOUR REQUIREMENTS. WE ARE NOT RESPONSIBLE FOR ANY OTHER DATA OR INFORMATION PROVIDED OR RECEIVED THROUGH PROJECT REQUIREMENT. EXCEPT AS EXPRESSLY SET FORTH HEREIN, MDQ MAKES NO WARRANTIES ABOUT THE INFORMATION SYSTEMS, SOFTWARE AND FUNCTIONS MADE ACCESSIBLE BY OR THROUGH PROJECT HUB OR ANY SECURITY ASSOCIATED WITH THE TRANSMISSION OF SENSITIVE INFORMATION. MDQ DOES NOT WARRANT THAT PROJECT WE BUILT FOR YOU WILL OPERATE ERROR-FREE, THAT ERRORS IN THE SERVICE WILL BE FIXED, THAT LOSS OF DATA WILL NOT OCCUR, OR THAT PROJECT HUB IS FREE OF COMPUTER VIRUSES, CONTAMINANTS OR OTHER HARMFUL ITEMS. UNDER NO CIRCUMSTANCES WILL MDQ, ANY OF OUR AFFILIATES, DISTRIBUTORS, PARTNERS, LICENSORS, AND/OR ANY OF OUR OR THEIR DIRECTORS, OFFICERS, EMPLOYEES, CONSULTANTS, AGENTS, OR OTHER REPRESENTATIVES BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY YOUR RELIANCE ON INFORMATION OBTAINED THROUGH THE SERVICE.

7. Limitations on Liability

YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH US IS THE CANCELLATION OF YOUR USE OF PROJECT EXECUTION. IN NO EVENT SHALL WE BE LIABLE TO YOU (OR TO ANY THIRD PARTY CLAIMING UNDER OR THROUGH YOU) FOR ANY DAMAGES WHATSOEVER, INCLUDING, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES OR ANY BODILY INJURY, EMOTIONAL DISTRESS, DEATH OR ANY OTHER DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APPLICATION BUILT BY US, WHETHER ON-LINE OR OFF-LINE, OR OTHERWISE IN CONNECTION WITH PROJECT. THESE EXCLUSIONS APPLY TO ANY CLAIMS FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL OR BUSINESS REPUTATION, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, ANY OTHER COMMERCIAL DAMAGES OR LOSSES, OR ANY PERSONAL INJURY OR PROPERTY DAMAGES, EVEN IF WE KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. MDQ’S LIABILITY UNDER THESE TERMS SHALL BE LIMITED TO THE AMC FEES YOU PAID FOR THE PERIOD OF MDQ PRIOR TO THE DATE THE CLAIM AROSE. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.

8. Choice of Law and Dispute Resolution

These Terms will be governed by and construed in accordance with the laws of the State of California without giving effect to principles of conflict of laws, and the parties consent to the jurisdiction of the federal courts of the State of California. Each party irrevocably submits to the jurisdiction and venue of any such court in any such action or proceeding. The United Nations Convention on Contracts for the International Sale of Goods will not apply to These Terms.

9. General Legal Terms

These Terms constitute the whole legal agreement between you and MDQ and govern your use of the Service and completely replace any prior agreements between you and MDQ, written or oral, in relation to Project Hub.

If any part of the Terms is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

The failure of MDQ to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision.

MDQ shall not be liable for failing or delaying performance of its obligations resulting from any condition beyond its reasonable control, including but not limited to, governmental action, acts of terrorism, earthquake, fire, flood or other acts of God, labor conditions, power failures, and Internet disturbances.

MDQ may assign this contract at any time to any parent, subsidiary, or any affiliated company, or as part of the sale to, merger with, or other transfer of our company to another entity. You may not assign these Terms.
